By accessing and using the Services provided by Danilo Capri Concierge, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. These Terms apply to all visitors, users, and others who access or use our Services.

We reserve the right to modify these Terms at any time. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.

3. Service Description

Danilo Capri Concierge provides luxury concierge services in Capri, Italy, including but not limited to:

  • Villa and accommodation bookings and management
  • Private boat charters and yacht rentals
  • Restaurant reservations and culinary experiences
  • Private tours and excursions
  • Transportation arrangements (helicopter, car service, etc.)
  • Event planning and special occasion arrangements
  • Personalized itinerary planning
  • VIP access and exclusive experiences
  • 24/7 concierge assistance during your stay

All Services are provided subject to availability. We act as an intermediary between you and Third-Party Providers and work diligently to ensure the quality of services delivered.

4. Booking Process

4.1 Making a Booking

To make a booking, you must provide accurate and complete information, including your full name, contact details, travel dates, and any special requirements. You are responsible for ensuring all information provided is correct. Any errors or omissions may affect your booking.

4.2 Booking Confirmation

A booking is confirmed only when you receive written confirmation from us via email. This confirmation will include booking details, dates, prices, and any applicable terms specific to your reservation. Please review the confirmation carefully and notify us immediately of any discrepancies.

4.3 Availability

All bookings are subject to availability at the time of confirmation. We cannot guarantee availability of any specific service, property, or experience until confirmed in writing. In the event a requested service is unavailable, we will make every effort to provide suitable alternatives.

4.4 Minimum Age Requirement

You must be at least 18 years of age to make a booking. By making a booking, you confirm that you meet this age requirement and have the legal capacity to enter into this Agreement.

5. Payment Terms

5.1 Pricing

All prices are quoted in Euros (EUR) unless otherwise stated. Prices include applicable taxes unless specifically noted otherwise. Prices are subject to change without notice until your booking is confirmed and payment is received.

5.2 Payment Methods

We accept payment via major credit cards (Visa, Mastercard, American Express), bank transfers, and other methods as specified at the time of booking. All payments are processed securely through our payment service providers.

5.3 Deposits and Full Payment

Depending on the service type and booking value, we may require:

  • A deposit at the time of booking (typically 20% of the total cost)
  • Full payment in advance for certain services
  • Balance payment by a specified date before your arrival

Payment terms will be clearly communicated in your booking confirmation. Failure to make payment by the due date may result in cancellation of your booking.

5.4 Service Fees

Our concierge service fees are included in the quoted prices unless otherwise specified. Additional services requested during your stay may incur extra charges, which will be communicated to you in advance.

5.5 Currency Conversion

If you choose to pay in a currency other than Euros, your bank or payment provider may apply currency conversion fees. We are not responsible for any fees charged by your financial institution.

6. Cancellation and Refund Policy

6.1 Cancellation by Client

Cancellation policies vary depending on the specific service booked and the Third-Party Provider's terms. Each service has its own cancellation policy which is clearly displayed on the service page and will be included in your booking confirmation.

Please review the specific cancellation terms for each service before making a booking. Cancellation policies may be stricter during peak season, holidays, or for special events. All cancellation requests must be submitted in writing to concierge@danilocapri.com.

6.2 Cancellation by Danilo Capri Concierge

We reserve the right to cancel a booking in exceptional circumstances, including but not limited to force majeure events, safety concerns, or if Third-Party Providers become unavailable. In such cases, we will provide a full refund or offer suitable alternative arrangements.

6.3 No-Shows

If you fail to arrive for your booking without prior cancellation, you will be charged the full booking amount with no refund.

6.4 Modifications

Requests to modify bookings are subject to availability and may incur additional fees. We will do our best to accommodate changes, but cannot guarantee any specific modification.

6.5 Refund Processing

Approved refunds will be processed within 14 business days and returned to the original payment method. We are not responsible for delays caused by financial institutions.

7. Client Responsibilities

7.1 Travel Documents

You are responsible for ensuring you have valid passports, visas, health certificates, and any other documents required for travel to and within Italy. We are not responsible for any issues arising from invalid or missing travel documents.

7.2 Travel Insurance

We strongly recommend purchasing comprehensive travel insurance covering cancellations, medical emergencies, personal liability, and other unforeseen circumstances. We are not liable for costs arising from events that would typically be covered by travel insurance.

7.3 Conduct and Behavior

You agree to conduct yourself in a respectful and lawful manner at all times. Any damage to property, offensive behavior, or violation of local laws may result in immediate termination of services without refund and potential legal action.

7.4 Special Requirements

You must inform us of any special requirements, dietary restrictions, medical conditions, mobility issues, or other needs at the time of booking. While we will make reasonable efforts to accommodate your needs, we cannot guarantee specific accommodations.

8. Limitation of Liability

8.1 Service Quality

While we strive to provide the highest quality services and carefully select our Third-Party Providers, Danilo Capri Concierge acts as an intermediary. We cannot be held liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of Third-Party Providers.

8.2 Force Majeure

We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, strikes, war, terrorism, pandemics, government restrictions, or other force majeure events.

8.3 Personal Injury and Property Damage

We are not liable for any personal injury, death, property damage, or loss suffered during your use of services provided by Third-Party Providers. You should direct any claims to the relevant Third-Party Provider and/or your insurance company.

8.4 Maximum Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to our Services shall not exceed the total amount paid by you for the specific booking giving rise to the claim.

8.5 Exclusions

We exclude all liability for indirect, consequential, incidental, or punitive damages, including but not limited to loss of profits, business interruption, or loss of enjoyment.

9. Intellectual Property Rights

All content on our website, including text, graphics, logos, images, videos, and software, is the property of Danilo Capri Concierge or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of our website content without our prior written consent, except for personal, non-commercial use.

10. User Account and Security

If you create an account on our website, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to disable any user account at any time if we believe you have violated these Terms.

11. Third-Party Links and Services

Our website may contain links to third-party websites or services that are not owned or controlled by Danilo Capri Concierge. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Naples, Italy, and you hereby consent to personal jurisdiction and venue therein.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and any specific terms provided in your booking confirmation, constitute the entire agreement between you and Danilo Capri Concierge regarding the use of our Services and supersede all prior agreements and understandings.
